By accessing this website or placing an order, you agree to the terms outlined below. Please read them carefully before purchasing.

Och & Aye is a Scottish creative studio offering paper goods, printed products, digital downloads, subscription items and creative services.

These Terms & Conditions apply to all purchases made through this website and to the use of any services provided by Och & Aye.

If you do not agree with these terms, please do not use this website.

Nothing in these Terms affects your statutory rights as a consumer under UK law.

2. Products & Services

Och & Aye offers:

  • Printed paper goods (cards, prints, decorations, mail club items)

  • Digital products and business kits

  • Custom design services (including branding and Squarespace website design)

We reserve the right to update, change, or discontinue products or services at any time without notice.

3. Pricing & Payment

All prices are shown in GBP (£).

Payment must be made in full at checkout before products are dispatched or digital goods are delivered.

We reserve the right to change prices at any time, but this will not affect orders already placed.

4. Shipping (Physical Products)

Orders are usually processed within 5 working days.

Delivery times are estimates only and may vary depending on location and postal services.

We are not responsible for delays caused by postal carriers once an order has been dispatched.

Customers are responsible for providing accurate delivery information.

If your order arrives damaged, please contact us within 7 days with photographs so we can help resolve the issue.

5. Digital Products

Due to the nature of digital downloads:

  • Digital products are non-refundable once access or download has been provided.

  • Files are for personal or single business use only.

  • You may not resell, redistribute, or share any files.

By purchasing a digital product and accessing it immediately, you agree that you waive your statutory right to cancel once the download begins.

6. Mail Club / Subscription Products

For subscription-based products:

  • Payments are taken as agreed at sign-up.

  • You may cancel future payments at any time before the next billing cycle.

  • Items already dispatched are non-refundable.

7. Custom Design Services

For branding, Squarespace websites, and other creative services:

  • A written agreement and invoice will outline the scope of work, timeline, and payment terms.

  • A deposit may be required before work begins.

  • Unless otherwise agreed, deposits are non-refundable once work has commenced.

  • Final files or websites will not be transferred until full payment is received.

  • Project timelines depend on client communication and feedback.

Och & Aye reserves the right to showcase completed work in portfolios and marketing materials unless agreed otherwise in writing.

8. Returns & Refunds

For physical goods:

You may return items within 14 days of receipt if:

  • The item is unused

  • The item is in its original condition

Unless the item is faulty or incorrect, return postage is the responsibility of the customer.

Custom-made and personalised items are non-refundable unless faulty.

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or Consumer Contracts Regulations 2013.

9. Intellectual Property

All designs, illustrations, products, digital files and content on this website remain the intellectual property of Och & Aye.

You may not copy, reproduce, modify, resell, or distribute any content without written permission.

Och & Aye is operated by Kirsteen Allison, a sole trader trading as Och & Aye and is the legal entity entering into contracts with customers.

11. Limitation of Liability

Och & Aye shall not be liable for:

  • Indirect or consequential loss

  • Loss of profits or business

  • Business interruption

  • Loss of data

Our total liability shall not exceed the amount paid for the product or service in question.

Nothing in these Terms excludes liability for death or personal injury caused by negligence or any other liability that cannot legally be excluded.

12. Privacy

Your personal information is handled in accordance with our Privacy Policy.

We may use third-party providers (such as payment processors or Shopify) to process orders securely.

13. Governing Law

These Terms are governed by the laws of Scotland.

Any disputes will be subject to the jurisdiction of the Scottish courts, although consumers may also have rights under the laws of their country of residence.
